ARTICLE I

GENERAL PROVISIONS

  1. These General Terms and Conditions, hereinafter referred to as the “GTC,” govern the rights and obligations of our company as the Seller and you as the Buyer, hereinafter referred to as the “Customer” or “You,” arising from the contractual relationship based on the purchase agreement concluded remotely, hereinafter referred to as the “Purchase Contract,” through our e-shop at https://www.mortreuxart.com/, hereinafter also referred to as the “e-shop.” These GTC form an integral part of the Purchase Contract.

  2. A Customer may be any natural person capable of legal acts or any legal entity that has expressed an interest in purchasing goods through https://www.mortreuxart.com/ and has completed and submitted an electronic order, thereby entering into a contractual relationship with the Seller.

Under certain circumstances, a third party designated by the Buyer in a binding Order as the person to whom the ordered goods are to be delivered shall also be considered a Buyer under these GTC, hereinafter referred to as the “Authorized Person.”

Providing the name, surname, delivery address and contact details of the Authorized Person in the binding Order shall be deemed authorization for that person to take over the ordered goods.

  3. By concluding the Purchase Contract, the Seller undertakes to deliver the ordered goods to the Buyer under the conditions specified in these GTC, and the Buyer undertakes to pay the agreed Purchase Price for the goods.

  4. The Seller processes all Orders independently and does not cooperate with other companies that execute Orders on behalf of the Seller. Any offer from a competing company is considered fraudulent and a misuse of the Seller’s reputation, goodwill and domain https://www.mortreuxart.com/.

  5. All relations between the Buyer and the Seller that are not regulated by these GTC are governed by the relevant provisions of Act No. 513/1991 Coll., the Commercial Code, as amended.

If the Buyer is a consumer within the meaning of Section 52(4) of Act No. 40/1964 Coll., the Civil Code, as amended, meaning a Buyer who does not act within the scope of business or other entrepreneurial activity when concluding and performing the Contract, relations not regulated by these GTC are governed by the relevant provisions of:

    • the Civil Code,
    • Act No. 102/2014 Coll. on Consumer Protection in the Sale of Goods or Provision of Services under a Distance Contract or Contract Concluded Outside the Seller’s Premises,
    • Act No. 250/2007 Coll. on Consumer Protection, and
    • other applicable legislation.
  6. These GTC govern the mutual rights and obligations of the Seller and the Buyer, collectively referred to as the “Contracting Parties,” arising in connection with or on the basis of the Purchase Contract, to the extent that the Contracting Parties have not agreed otherwise.

Deviations from these GTC may be agreed in the Purchase Contract only in writing. Approval of any amendment by e-mail shall also be considered a written agreement.

Any provisions expressly agreed in the Purchase Contract shall take precedence over these GTC. VOP_Mortreux EN

ARTICLE III

ORDERS

Your Order may be placed through the Order form published on our website:

https://www.mortreuxart.com/

ORDERING PROCEDURE

STEP NO. 1: SENDING AN ORDER FORM TO OUR COMPANY

  1. Through our e-shop, the Customer may order any goods displaying:

    • a shopping basket icon,
    • product code,
    • product price.

The presentation of goods in the online store does not constitute a legally binding offer. It represents only a non-binding online catalogue.

  2. After clicking the shopping basket icon, the selected goods are automatically added to the shopping basket, which may be reviewed at any time.

After adding goods to the basket, the Customer may either:

    • proceed to checkout by completing the prepared Order form, or
    • continue shopping.

When creating an Order, the Customer must provide all information required by the system.

If the Customer provides a Company ID number, it is assumed that the Customer is acting and purchasing as an entrepreneur rather than as a consumer.

The information provided will be used to create the Order and fulfil the Purchase Contract.

The validity of the electronic Order depends on the complete and accurate completion of all required information.

  3. Before submitting the Order, the Buyer has the opportunity to check and modify the information entered in the Order form and correct any errors.

  4. By clicking the “ORDER WITH PAYMENT OBLIGATION” button, the Customer submits a binding Order to the Seller and confirms that:

    • the Customer is familiar with the main characteristics of the goods,
    • the Customer knows the total price of the goods,
    • the Customer knows the transport, postage and other costs,
    • the Customer has selected an appropriate payment method from the options offered,
    • all information entered in the Order is complete and correct.

STEP NO. 2: ACKNOWLEDGMENT OF ORDER ACCEPTANCE

  1. An Order submitted by the Buyer in accordance with these GTC is considered a proposal to conclude a Purchase Contract for delivery of the ordered goods.

The Seller will evaluate the received Order and determine whether to accept it.

The Seller is not obliged to accept the Order even if it is technically possible to fulfil it.

  2. After the Order form is submitted, the Order will be registered in our information system.

The Customer will receive an e-mail titled “CONFIRMATION OF THE ORDER ACCEPTANCE.”

If such confirmation is not received, it shall be presumed that the Purchase Contract was not concluded between the Seller and the Buyer.

The confirmation e-mail will include a complete summary of the Order and the wording of the Purchase Contract, including:

    • billing information,
    • delivery information,
    • contact details.

The Customer may check this information and, if any changes or additions are required, contact us at:

    gmortreux@m-p.sk

  3. Upon delivery of the confirmation of Order acceptance to the Buyer, the Purchase Contract becomes concluded and binding.

The subject of the Contract is delivery of the goods specified in the Order at the stated price and under the conditions set out in these GTC.

We will subsequently check the Order and the availability of the goods.

STEP NO. 3: INFORMATION ABOUT ORDER DISPATCH

  1. We will begin fulfilling the concluded Purchase Contract.

We will notify the Customer by e-mail about the status of the Order and its dispatch to the address provided in the Order form.

  2. We will properly package the goods and send them within the specified period.

The Buyer undertakes to accept the ordered goods and pay the agreed Purchase Price.

IMPORTANT INFORMATION REGARDING ELECTRONIC ORDERS

  1. By completing and submitting the Order form, the Customer consents to receiving electronic invoices.

To ensure proper fulfilment of the Purchase Contract, the Customer must immediately inform us of any changes that may affect delivery of electronic invoices, especially changes to the e-mail address.

  2. If necessary, all additional information regarding the Order may be sent to the Customer’s e-mail address.

  3. The Buyer is required to check the content of the electronic Order stated in the “ORDER CONFIRMATION” e-mail.

If any discrepancy is discovered, the Buyer must notify the Seller immediately by e-mail.

  4. The essential elements of an electronic Order include:

    • Buyer identification,
    • business name or first and last name,
    • registered office or permanent address,
    • Company ID number,
    • telephone and e-mail address,
    • code or description of the ordered goods,
    • quantity,
    • delivery address.
  5. By submitting an electronic Order, the Buyer confirms that the Buyer has read these GTC and fully agrees to them.

The Seller reserves the right to modify these GTC without prior notice.

The version of the GTC valid on the day the Purchase Contract is concluded forms an integral part of that Contract.

  6. Depending on the nature of the Order, the Seller may request additional confirmation from the Buyer in writing or by telephone.

  7. By submitting the Order, the Buyer agrees to the use of remote communication methods in connection with the Purchase Contract.

Any costs related to the use of communication methods, especially internet access costs, shall be borne by the Buyer. VOP_Mortreux EN VOP_Mortreux EN

INDIVIDUAL ORDER

An Individual Order is an Order placed through:

gmortreux@m-p.sk

The Customer may order goods based on an individual idea or specific requirements.

Because this is an artistic activity, the Customer may request, for example:

  • atypical colors,
  • non-standard sizes,
  • larger quantities,
  • several types of goods,
  • goods not displayed in the e-shop,
  • other customized specifications.

Interested Customers may contact us to arrange individual delivery conditions and pricing.

STEP NO. 1: SENDING AN INDIVIDUAL ORDER

  1. Individual or customized Orders are created through:

    gmortreux@m-p.sk

Sending an Individual Order itself does not constitute conclusion of a Purchase Contract.

It represents only a draft Purchase Contract that may be modified until a binding Order is submitted.

STEP NO. 2: PROPOSAL OF IMAGE DESIGN WITH A PRICE OFFER

  1. After receiving the completed request, we will prepare a proposed design together with a price quotation within three working days.

The design may be further modified according to the Customer’s request and mutual agreement.

STEP NO. 3: CONFIRMATION AND PRICE ACCEPTANCE

  1. If the Customer wishes to order custom-made goods, the Customer must send an e-mail stating:

    “I CONFIRM INDIVIDUAL ORDER”

within five working days after the proposed modification is sent.

The Customer must provide identification, invoicing and delivery information requested by the Seller.

Only after confirmation and acceptance of the quotation will an “ORDER WITH PAYMENT OBLIGATION” be created.

By submitting the binding Order, the Customer confirms familiarity with:

    • the main characteristics of the goods,
    • the total price,
    • shipping and postage charges,
    • other costs,
    • the selected payment method.

The Customer also confirms that all Order information is complete and correct.

  2. After confirmation, the Order becomes binding and we will begin fulfilling it by preparing and modifying the goods according to the Customer’s requirements.

  3. If the Customer does not send the confirmation, it shall be presumed that no Purchase Contract was concluded.

  4. Upon delivery of the Customer’s confirmation accepting the price, the Purchase Contract becomes binding.

STEP NO. 4: INFORMATION ABOUT ORDER DISPATCH

  1. Once the price offer has been confirmed, we will begin fulfilling the Purchase Contract and notify the Customer by e-mail when the Order is dispatched.

  2. We will package the goods appropriately and send them within the specified period.

The Buyer undertakes to accept the goods and pay the agreed Purchase Price. VOP_Mortreux EN VOP_Mortreux EN

ARTICLE IV

RESERVATION OF OWNERSHIP

  1. All submitted Orders “WITH OBLIGATION OF PAYMENT” are binding.

  2. Ownership of the goods is transferred to the Buyer only after both of the following conditions are fulfilled:

    • the Buyer takes over the goods, and
    • the Purchase Price is paid.
  3. Unless otherwise agreed in the Purchase Contract, the risk of damage, accidental damage or accidental deterioration of the goods passes to the Buyer when the Seller fulfils the obligation to deliver the goods.

This applies regardless of whether the Buyer personally takes over the goods or arranges for an Authorized Person to do so.

Damage occurring after the transfer of risk does not affect the Buyer’s obligation to pay the Purchase Price and delivery costs.

ARTICLE V

DELIVERY CONDITIONS

  1. The usual delivery period is approximately 3 to 10 working days from conclusion of the Purchase Contract.

    This period is informative only.

    Delivery depends primarily on:

    • the distance between the delivery address and the Seller’s place of business,
    • whether and to what extent the product is customized.
  2. If the Buyer is a consumer, the Seller is obliged to deliver the goods no later than 30 days after receiving the binding Order.

If customization is requested, the delivery period may be extended by the time required for customization.

If the Seller fails to deliver within this period, the Buyer may request delivery within an additional reasonable period.

If the Seller still fails to deliver, the Buyer may withdraw from the Purchase Contract.

  3. The Seller may invite the Buyer to take over the goods before expiry of the agreed delivery period.

  4. If the ordered goods or part of the Order cannot be delivered within the stated period, we will inform the Customer immediately by e-mail or telephone.

    We may:

    • provide an expected delivery date, or
    • propose alternative goods.

If the goods cannot be supplied even within an additional period, the Customer may withdraw from the Contract.

Any Purchase Price already paid will be refunded to the Customer’s bank account within 14 days.

  5. Personal collection from the Seller’s store is possible only if the ordered goods are physically available at the store.

If the goods are unavailable, an alternative procedure will be agreed with the Customer.

  6. Goods delivered to the Buyer’s address are sent via Slovak Post as:

    • a letter,
    • parcel,
    • cash-on-delivery letter or parcel,
    • courier shipment.

Delivery by Slovak Post generally requires an additional 1 to 3 business days.

Courier delivery generally requires one working day.

  7. We will inform the Customer by e-mail when:

    • the Order has been handed over to the carrier, or
    • the Order is ready for personal collection.

If the goods have not been delivered within seven days after our e-mail notification, please contact both the delivery provider and us.

  8. The Customer is obliged to take over the goods at the agreed place and time personally or arrange for another person to take them over.

Receipt of the goods will be confirmed in writing on the delivery note.

The Customer will receive an invoice, which also serves as a warranty document.

  9. The Seller fulfils the obligation to deliver the goods when the Buyer or Authorized Person is allowed to take possession of them at the designated place of delivery.

  10. The Seller is considered to be in delay only if the Seller delays delivery to the Buyer or carrier.

The Seller is not considered to be in delay where fulfilment is prevented by circumstances on the Buyer’s side or by a subcontractor.

  1. The delivery obligation is considered fulfilled even if the Customer fails to take over the goods at the agreed time and place or refuses delivery.

If the goods are returned to the Seller, the Seller may withdraw from the Purchase Contract and request:

a. reimbursement of costs associated with returning the goods;
b. payment of the full Purchase Price where the Buyer ordered customized goods.

Re-delivery is possible only by mutual agreement, and the Buyer must pay any additional delivery costs.

  1. The Seller is not obliged to take back packaging material in which the goods were delivered.

  2. Partial deliveries are permitted.

The Buyer is obliged to accept them.

The Seller may invoice an appropriate proportion of the agreed transport price for each partial delivery. VOP_Mortreux EN VOP_Mortreux EN

ARTICLE VI

RESPONSIBILITY FOR DELAYED DELIVERY OF ORDERED GOODS

  1. The Seller is not responsible for delayed delivery caused by:

    • the postal service,
    • courier company,
    • incorrectly entered delivery address.
  2. Upon receiving the shipment, the Customer may inspect the package for mechanical damage caused during transport and verify whether the goods are free of defects.

If the shipment or goods are visibly damaged, the Customer may refuse delivery.

ARTICLE VII

PURCHASE PRICE AND PAYMENT TERMS

  1. The Seller is not a VAT payer and is registered for VAT only in accordance with Section 7a of the VAT Act.

All prices displayed in the e-shop are final but do not include delivery costs.

Prices may vary slightly depending on product customization.

  2. Prices are valid for the entire period during which they are displayed in the e-shop.

This does not affect the Seller’s right to conclude a Purchase Contract under individually agreed conditions.

  3. Promotional or special prices are valid:

    • until the date stated in the product details, or
    • until stock is sold out.

Additional discounts and individual Customer discounts cannot be combined unless otherwise stated.

  4. Each shipment includes an invoice, which also serves as a warranty certificate.

  5. The Purchase Price is considered paid when the full amount is credited to the Seller’s account.

  6. At its discretion, the Seller may provide the Buyer with:

    • a one-time discount,
    • repeated discounts,
    • a permanent discount for future purchases.
  7. The Seller reserves the right to continuously update prices in the e-shop.

However, after the Buyer submits an Order, the prices stated in that Order remain binding and unchanged for both Contracting Parties.

TERMS OF PAYMENT

Payment may be made by:

  • cashless bank transfer through Internet banking, or
  • PayPal.

When payment by bank transfer is selected, the Buyer must pay before delivery.

The Buyer will receive an e-mail containing the necessary payment information, including:

  • account number,
  • IBAN,
  • exact amount,
  • variable symbol or other payment identifier.

Alternatively, payment may be processed through PayPal.

The Buyer’s payment obligation is fulfilled when the full Purchase Price is credited to the Seller’s bank account.

Payment must be made within 14 days from the date on which the payment instructions are sent by e-mail.

After payment is credited, the Buyer will be informed and notified about dispatch of the Order.

If payment is not received correctly and on time, the Seller may withdraw from the Purchase Contract. VOP_Mortreux EN

  1. If the Customer wishes to cancel an Order that has not yet been processed, the Customer should contact us as soon as possible in writing or electronically and provide the Order number, provided the Purchase Price or advance invoice has not yet been paid.

  2. The Buyer may cancel the Order within 48 hours after submitting it by:

    E-mail: gmortreux@m-p.sk
    Telephone: +421 902 047 921

  3. If the Order is cancelled after payment but before delivery, and the delivery period has not yet expired, the Seller reserves the right to deduct proven costs associated with processing the Order.

Any remaining amount will be refunded to the account from which payment was made within 14 days at the latest.

For card payments such as VISA or MasterCard, this period may be longer due to the bank’s refund procedures.

  4. The Seller reserves the right to cancel an Order or part of it if:

    • technical reasons make delivery impossible,
    • the required delivery period cannot be met,
    • the Order conditions cannot be fulfilled,
    • the goods are no longer manufactured or supplied,
    • the supplier significantly changes the price.

In such cases, the Seller will contact the Customer immediately to agree on further steps.

If the Customer has already paid and no agreement can be reached regarding alternative goods or performance, the Seller will refund the payment within 14 days. VOP_Mortreux EN

ARTICLE X

CONDITIONS OF WITHDRAWAL FROM THE PURCHASE CONTRACT

WHEN YOU CAN WITHDRAW FROM THE PURCHASE AGREEMENT

  1. A Customer acting as a consumer has the right to withdraw from a remotely concluded Contract without giving any reason within 14 days from receiving the goods.

The withdrawal period is considered observed if the withdrawal notice is sent to the Seller no later than the final day of that period.

Goods are considered received when the Customer or a third party designated by the Customer, other than the carrier, takes over all parts of the ordered goods.

    Where:

    a. goods ordered in one Order are delivered separately, the period begins after receipt of the last delivered item;
    b. goods consist of several parts or pieces, the period begins after receipt of the final part or piece;
    c. goods are delivered repeatedly during a specified period, the period begins after receipt of the first delivery.

  2. Withdrawal from the Purchase Contract cancels the Contract from the beginning, as well as any ancillary contract relating to it.

  3. A consumer Buyer may withdraw from a Contract concerning delivery of goods even before the withdrawal period begins.

  4. The Customer may not withdraw from a Contract where the subject is:

    • goods made according to the Customer’s specific requirements,
    • custom-made goods,
    • goods intended specifically for one consumer,
    • goods that, by their nature, become inseparably mixed with other goods after delivery.

PROCEDURE FOR WITHDRAWAL FROM THE PURCHASE CONTRACT

  1. To exercise the right of withdrawal, the Customer must clearly inform the Seller of the decision to withdraw.

    Notice may be sent to:

    Mortreux & Partner Group, s.r.o.
    Šafárikovo námestie 4
    Bratislava-Staré Mesto 811 02
    Slovak Republic

    E-mail: gmortreux@m-p.sk

The Customer may use the Withdrawal Form included as Annex No. 1 to these GTC and published at https://www.mortreuxart.com/.

  2. After exercising the right of withdrawal, the Customer must return the goods no later than 14 days after withdrawal to:

    Mortreux & Partner Group, s.r.o.
    Šafárikovo námestie 4
    Bratislava-Staré Mesto 811 02
    Slovak Republic

We recommend sending the goods by registered parcel.

Do not send the goods by cash on delivery.

    The Customer must include:

    • a copy of the invoice,
    • a copy of the delivery confirmation.

Goods may also be returned personally to the Seller’s store.

If another Authorized Person returns the goods, the Customer should identify that person in the withdrawal notice.

  3. The goods must not show signs of use and must be returned with complete accessories and documentation.

The Customer may unpack and inspect the goods in the same way as would normally be possible in a physical retail store.

However, the Customer must not use the goods beyond what is necessary to determine their characteristics and functionality.

The Customer is responsible for any reduction in value caused by excessive handling.

CONSEQUENCES OF WITHDRAWAL FROM THE PURCHASE CONTRACT

  1. Withdrawal terminates the Purchase Contract from the beginning.

Where the Contract concerns multiple goods, the Customer may withdraw only in relation to part of the Contract.

  2. A consumer who withdraws from the Contract bears the cost of returning the goods to the Seller, including any costs associated with goods that cannot normally be returned by post.

  3. The Buyer is not entitled to withdraw if:

    • the goods show signs of damage or use, or
    • the goods are incomplete.

In such cases, the Seller reserves the right to refuse the return or, by agreement with the Customer, charge the costs required to restore the goods to their original condition.

  4. The Seller will refund all payments received from the Customer under or in connection with the Purchase Contract, including shipping, delivery and postage costs, without undue delay and no later than 14 days after receiving the withdrawal notice.

The refund will be made using the same payment method used by the Customer unless otherwise agreed.

The Seller is only required to refund delivery costs up to the value of the cheapest standard delivery option offered.

The Seller is not obliged to issue the refund before:

    • receiving the returned goods, or
    • receiving proof that the Customer has sent the goods back. VOP_Mortreux EN VOP_Mortreux EN

ARTICLE XI

NON-ACCEPTANCE OF AN ORDERED SHIPMENT

  1. Failure by the Customer to accept an ordered shipment cannot be considered a valid withdrawal from the Purchase Contract under applicable law.

  2. The Seller has the right to require the Buyer to reimburse all costs associated with non-acceptance of the shipment.

Disputes will preferably be resolved by mutual agreement in accordance with the laws of the Slovak Republic.

ARTICLE XII

WARRANTY

  1. The statutory warranty period is 24 months and begins on the date the Customer receives the goods, unless otherwise stated.

Claims concerning defective goods must be made before the warranty period expires.

After expiry of the warranty period, the right to make a warranty claim expires.

The warranty period is extended by the period during which the Buyer could not use the goods due to warranty repair.

  2. All goods purchased from the Seller are delivered with an invoice serving as:

    • proof of purchase,
    • warranty document.
  3. The warranty does not cover damage caused by:

    • normal use,
    • improper use,
    • improper storage.
  4. The Seller is responsible for:

    • maintaining the price valid at the time the Customer submitted the Order, if accepted,
    • dispatching goods without defects,
    • delivering goods in the quantity and quality stated in the accepted Order,
    • including an invoice unless otherwise requested.
  5. The Seller is not liable for defects caused by:

    • unprofessional modification or repair,
    • use or handling contrary to manufacturer instructions,
    • violation of applicable technical standards,
    • thermal, chemical or mechanical damage occurring after transfer of risk,
    • improper storage,
    • improper handling,
    • improper transport.
  6. The limitation in Point 3 does not apply to:

    • goods sold at a lower price because of an acknowledged defect,
    • normal wear and tear,
    • defects in used goods corresponding to the level of prior use,
    • defects resulting from the nature of the goods. VOP_Mortreux EN

ARTICLE XIII

SELLER’S LIABILITY FOR DEFECTS IN GOODS

  1. If a defect can be repaired, the Buyer has the right to have it repaired:

    • free of charge,
    • properly,
    • within a reasonable time.

The Seller is obliged to remove the defect without undue delay.

  2. Instead of repair, the Buyer may request replacement of the goods or replacement of the defective part if this does not impose disproportionate costs on the Seller considering:

    • the price of the goods,
    • severity of the defect.
  3. The Seller may replace defective goods with defect-free goods instead of repairing them, provided that this does not cause serious inconvenience to the Buyer.

  4. If the defect cannot be repaired and prevents proper use of the goods, the Buyer has the right to:

    • replacement of the goods, or
    • withdrawal from the Purchase Contract.

The same applies if repairable defects repeatedly occur or if there are multiple defects preventing proper use.

  5. For other irreparable defects, the Buyer is entitled to an appropriate reduction in the Purchase Price.

ARTICLE XIV

COMPLAINTS AND WARRANTY CONDITIONS

  1. The Complaints Procedure governs the actions of the Seller and Buyer in exercising rights arising from defects in goods purchased through https://www.mortreuxart.com/.

  2. Complaints are handled according to applicable laws of the Slovak Republic.

Consumer claims are governed by the relevant provisions of the Civil Code and consumer protection legislation.

Claims from Buyers who are not consumers are governed by the relevant provisions of the Commercial Code.

  3. Warranty service is provided by the Seller as operator of the e-shop.

  4. The Customer must visually inspect the goods immediately after receipt.

The Customer may refuse delivery if:

    • the goods show visible mechanical transport damage,
    • the packaging is visibly damaged,
    • the shipment is incomplete.

In such cases, the Customer must:

    • prepare a damage or complaint report with the courier or driver, or
    • refuse delivery.

Incomplete shipments or damaged goods must be reported within 48 hours after receipt to:

    gmortreux@m-p.sk

Later complaints regarding incomplete shipments or mechanical damage will be accepted only if the Buyer proves that the defect already existed at the time of receipt.

  5. If the Buyer discovers that the goods are incomplete or damaged during transport, even where the packaging is not visibly damaged, or discovers another deficiency, the Buyer must make a complaint immediately.

  6. The Buyer must notify the Seller of defects without undue delay.

Continued use of damaged goods may:

  • worsen the defect,
  • reduce the value of the goods,
  • affect the outcome of the complaint procedure.
  1. Each complaint will be resolved no later than 30 days after the Seller receives the claimed goods.

If processing takes longer, the Customer will be informed of the status.

  1. The Seller is not responsible for defects caused by:
    • mechanical damage,
    • unsuitable operating conditions,
    • chemically aggressive environments,
    • dusty environments,
    • unauthorized intervention,
    • natural disasters,
    • force majeure.
  2. A defect does not include a change in the characteristics of the goods caused by:
    • normal wear,
    • misuse,
    • insufficient or inappropriate treatment,
    • natural changes in materials,
    • damage caused by the Buyer,

COMPLAINTS PROCEDURE

  1. To make a complaint regarding goods purchased from our e-shop, contact us:

    E-mail: gmortreux@m-p.sk

    or in writing at:

    Mortreux & Partner Group, s.r.o.
    Šafárikovo námestie 4
    Bratislava-Staré Mesto 811 02
    Slovak Republic

The claimed goods should be sent as a registered parcel and generally not by cash on delivery.

    The package must include:

    • the completed Complaint Form in Annex No. 2,
    • proof of purchase,
    • warranty documentation.

    The Complaint Form should include:

    • reason for complaint,
    • business name, if applicable,
    • first and last name,
    • address,
    • delivery address,
    • description of the goods,
    • bank account name and number if requesting a refund,
    • date,
    • signature.
  2. Only goods purchased from and fully paid to the Seller may be subject to a complaint.

    The Buyer must clearly describe:

    • the defect,
    • how the defect appears.

Complaint processing applies only to defects listed in the Complaint Form.

  3. If the Complaint Form is incomplete or missing proof of purchase or receipt, the Seller will contact the Buyer by telephone or e-mail and request the missing information or documents.

  4. If the Seller cannot reach the Buyer after repeated attempts, or if the Buyer does not respond within seven days after receiving the Seller’s request, the Seller reserves the right to discontinue the complaint procedure.

The goods may then be returned to the Buyer at the Buyer’s expense.

  5. If the claimed goods are not sent together with the completed Complaint Form and required documents, the Seller may suspend processing until the goods are delivered.

If the Buyer fails to deliver the goods even after being requested to do so, it will be assumed that the Buyer does not intend to pursue the complaint or replacement.

  6. The Seller recommends that the Buyer insure goods being returned, replaced or submitted for complaint.

The Buyer bears the risk of damage until the Seller receives the goods.

  7. After receiving the claimed goods, we will contact the Customer promptly by e-mail or telephone to agree on a quick resolution.

  8. When assessing defects, the relevant provisions of the Civil Code will apply.

Repairable defects must be removed without undue delay.

At the Buyer’s request, replacement may be provided where appropriate.

If a defect cannot be repaired and prevents normal use, the Buyer may request:

    • replacement, or
    • withdrawal from the Contract.
  9. Complaints may be resolved by:

    • returning repaired goods,
    • replacing the goods,
    • refunding the Purchase Price,
    • granting an appropriate price reduction,
    • issuing a written invitation to take over the performance,
    • justified rejection of the warranty claim.
  10. If the complaint is accepted, we may:

    • replace the claimed goods,
    • provide another product chosen by the Customer up to the value of the claimed goods,
    • cover the cost of returning and delivering replacement goods,
    • allow withdrawal from the Contract and provide a refund.
  11. The Seller, an authorized employee, or another person authorized to carry out repairs must handle the complaint immediately.

In complex cases, it must be handled within three working days, excluding time required for professional assessment.

The complaint procedure may not exceed 30 days after the complaint is filed and the goods are received.

If this period is exceeded, a consumer Buyer has the same rights as in the case of an irreparable defect.

The Buyer will be informed about the result by e-mail and will receive a complaint report stating:

  • date,
  • method of resolution,
  • repair confirmation,
  • repair duration,
  • or written justification for rejecting the complaint.
  1. If the Seller does not accept the complaint within three working days, the Seller must send the goods for professional assessment at the Seller’s expense.

  2. If a complaint is made within the first 12 months after conclusion of the Purchase Contract, the Seller may reject it only on the basis of an expert opinion.

The Seller bears the full cost of such professional assessment.

  1. If a complaint is filed after 12 months and rejected, the Seller must state where the Buyer may send the goods for professional assessment.

The Seller bears the costs associated with the professional assessment performed through the specified contact, regardless of the result.

If the professional assessment establishes the Seller’s liability for the defect, the Customer may submit the complaint again.

The warranty period is suspended during the professional assessment.

The Seller must reimburse all reasonably incurred assessment costs within 14 days after the complaint is resubmitted.

A resubmitted complaint supported by such an assessment cannot be rejected. VOP_Mortreux EN VOP_Mortreux EN VOP_Mortreux EN

ALTERNATIVE DISPUTE RESOLUTION

  1. The Seller prefers to resolve disputes with the Buyer out of court.

If the Buyer is dissatisfied with the handling of a complaint or believes that the Seller has violated the Buyer’s rights, the Buyer may first contact the Seller at:

In accordance with Act No. 391/2015 Coll. on Alternative Dispute Resolution, the Buyer may also submit a proposal to initiate Alternative Dispute Resolution, or ADR, to an appropriate entity such as:

    • another legal entity registered on the list of ADR entities maintained by the Ministry of Economy of the Slovak Republic.

ARTICLE XVII

FINAL PROVISIONS

  1. These GTC have been prepared and established in good faith to comply with legal requirements and ensure fair business relations between the Seller and Buyer.

Consumer rights arising under applicable consumer protection legislation remain unaffected.

Legal relations and issues not expressly regulated by these GTC, as well as disputes arising from non-compliance with them, are governed by the relevant provisions of:

    • the Commercial Code,
    • Civil Code,
    • Consumer Protection Act,
    • other applicable consumer protection legislation.

If the Buyer has a domicile or place of business outside the Slovak Republic, the Contracting Parties agree to exclude application of the United Nations Convention on Contracts for the International Sale of Goods.

This also applies to legal relationships containing an international element.

  2. If any provision of these GTC becomes invalid or unenforceable, the validity and enforceability of the remaining provisions will not be affected.

The Contracting Parties undertake to replace the invalid or unenforceable provision with a valid provision that reflects its original purpose as closely as possible.

  3. The Seller may assign or transfer the Purchase Contract, any part of it, or individual rights and obligations arising from it to a third party, provided that the Buyer is notified in writing in advance.

By entering into the Purchase Contract, the Buyer gives irrevocable consent to such assignment or transfer.

  4. The Buyer may not assign or transfer the Purchase Contract, any part of it, or rights and obligations arising from it to a third party without the Seller’s prior written consent.

  5. FORCE MAJEURE: A Contracting Party is released from liability for damages if it proves that fulfilment of the Purchase Contract was temporarily or permanently prevented by an exceptionally unforeseeable and unavoidable obstacle beyond its control.

  6. The Purchase Contract may be amended only by written agreement of both Contracting Parties.

  7. These GTC apply unless otherwise expressly agreed in writing between the Seller and Buyer or unless otherwise required by applicable law.

Special conditions contained in the Purchase Contract take precedence over these GTC.

  8. By confirming the “Order with the payment obligation” button before submitting the Order, the Buyer declares that the Buyer:

    • has read these GTC,
    • fully understands their content,
    • agrees with them.
  9. The current version of these GTC is available electronically at:

https://www.mortreuxart.com/obchodne-podmienky

  1. The Seller may amend or supplement these GTC unilaterally at any time, particularly where:
    • applicable laws change, or
    • the Seller changes the way business activities are conducted.

Such amendments do not affect rights and obligations arising from Purchase Contracts concluded before the effective date of the amended GTC.

Notification of amendments is not a condition for their validity.

The Buyer is therefore obliged to review the currently effective wording before submitting an Order.

The updated version replaces the previous version and becomes effective:

a. on the date it is published on the Seller’s website, if published there; or
b. on the day following electronic delivery by e-mail to the Buyer, if it is not published on the website.

  1. The Seller and Buyer agree that remote forms of communication, including:
    • telephone,
    • e-mail,
    • Internet communication,

are valid and binding for both Contracting Parties.

  1. These GTC are effective from November 23, 2020. VOP_Mortreux EN VOP_Mortreux EN
